Terms of Service

These Terms of Service ("Terms") are an agreement between you and PIKUP ("Pikup," "we," "us"). They cover your use of https://pikup-ai.com (the "Site") and the Pikup AI receptionist service (the "Service"). If you use the Service on behalf of a business, you agree to these Terms for that business. If you don't agree, don't use the Site or the Service.

1. The Service

Pikup is an AI receptionist for home service businesses. It answers calls to your business, can book appointments on your calendar, can transfer calls to you, and sends you summaries of calls. We set up and configure the Service for your business based on the information you give us.

2. Subscription, billing, and cancellation

• Price: $297 per month, billed monthly in advance, plus any applicable taxes.
• No setup fee.
• Cancel anytime: there's no long-term contract. You can cancel by emailing [email protected]. Cancellation takes effect at the end of your current billing period, and you won't be charged again. We don't give refunds for partial months.
• Price changes: we'll give you at least 30 days' notice before a price change takes effect. You can cancel before then.
• Failed payments: if a payment fails, we may pause the Service until it's resolved.

3. Setup

We aim to have your receptionist live within 48 hours of receiving the information we need from you. Timing depends on how quickly you provide that information and set up call forwarding, so this is a target, not a guarantee.

4. Your responsibilities and acceptable use

You agree to:

• Give us accurate information about your business, services, hours, and booking rules, and keep it up to date.
• Use the Service only for lawful purposes and only for calls to and from your own business.
• Not use the Service to send spam, robocalls, or unsolicited marketing, or in any way that violates telemarketing, consumer protection, or privacy laws (including the Telephone Consumer Protection Act).
• Not use the Service to harass, deceive, or harm anyone, or to process content that is illegal or infringes others' rights.
• Not try to copy, reverse engineer, disrupt, or gain unauthorized access to the Service.

5. AI limitations and your compliance obligations

• AI can make mistakes. The Service uses artificial intelligence. It may misunderstand callers, give incomplete or incorrect information, book the wrong time, or fail to transfer a call. Review your call summaries and bookings, and confirm important details with your customers.
• Not an emergency service. The Service is not a substitute for 911 or any emergency service, and it should not be relied on for life-safety situations.
• You are responsible for your own compliance, including any laws that apply to recording calls (some states require all parties' consent), to telling callers they're speaking with an AI or automated system, and to how you use the information collected from your callers.

6. Your data

You own the data from your business's calls. You give us permission to use it to provide, maintain, and improve the Service. Our Privacy Policy explains how we handle personal information.

7. Third-party services

The Service works with third-party services such as phone carriers, calendars, and AI providers. We aren't responsible for those services, and their own terms may apply.

8. Our intellectual property

The Site, the Service, and the Pikup name and logo belong to us. These Terms don't give you any rights to them except to use the Service as described here.

9. Disclaimers

THE SITE AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL ANSWER OR BOOK EVERY CALL CORRECTLY.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, PIKUP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, JOBS, OR DATA, ARISING FROM YOUR USE OF THE SITE OR THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend and indemnify us against claims arising from your use of the Service in violation of these Terms or the law, including claims related to call recording, AI disclosure, or how you use your callers' information.

12. Suspension and termination

We may suspend or end your access to the Service if you violate these Terms, if your payment fails and isn't resolved, or if your use creates legal or security risk. You can stop using the Service at any time by cancelling as described above.

13. Governing law

These Terms are governed by the laws of the State of UTAH, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in UTAH, and you and we consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. We'll post the new version here and update the effective date. If a change is significant, we'll give you notice before it takes effect. Continuing to use the Service after a change means you accept it.
